Terms of Sale

1. Scope

These Terms of Sale (ToS) govern sales of the "Pro" subscription of the PokéItem app, operated by SAS POKEITEM, SIREN 105 186 597, RCS Toulouse, share capital €1,000, 26A route de Léguevin, 31820 Pibrac, France.

Any subscription order implies full and unreserved acceptance of these ToS as well as the Terms of Use (ToU).

2. Description of the paid Service

The PokéItem Pro subscription is a digital service giving access to the advanced features of the PokéItem app, notably:

• →Unlimited management of cards and collections
• →Advanced statistics and valuation history
• →Market analysis and tracking tools
• →Export and backup of collection data
• →Priority access to new features

The details of the included features may change; the features available at the time of subscription are those shown on the Pricing page.

3. Pricing

Prices are shown in euros, all taxes included (incl. VAT). PokéItem reserves the right to change its pricing at any time, with at least 30 days' notice given by email. The applicable price is the one in effect at the time of subscription or renewal.

4. Ordering process

Subscribing to the Pro plan is done directly in the PokéItem app. The user must:

1. Hold an active PokéItem account
2. Select the Pro plan from their account settings
3. Enter their payment information
4. Confirm the order

A confirmation email is sent to the address associated with the account within minutes of subscribing.

5. Payment

Payment is made online securely through our payment provider. The accepted payment methods are indicated during the ordering process (Visa, Mastercard, etc.).

PokéItem does not store any banking data. Transaction processing is fully delegated to our PCI-DSS certified payment provider.

In the event of a failed payment, access to the Pro features is suspended until the situation is resolved.

6. Term and renewal

The Pro subscription is taken out for a term of one (1) year, automatically renewable by tacit renewal for an identical term, unless cancelled by the user before the renewal date.

A renewal reminder is sent by email at least 7 days before the subscription's renewal date.

7. Right of withdrawal

To exercise this right, send an explicit request to [email protected] stating your account email address and the subscription date.

Exception: in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content whose performance has begun with the consumer's express consent and express waiver of their right of withdrawal. If the user has requested immediate access to the Pro features and has expressly consented to it, the right of withdrawal no longer applies.

8. Cancellation

The user may cancel their subscription at any time from their account settings or by contacting [email protected].

Cancellation takes effect at the end of the current subscription period. Access to the Pro features remains active until that date. No pro-rata refund will be made for the remaining period, except under the right of withdrawal (article 7).

PokéItem reserves the right to terminate a subscription in the event of a breach of the ToU, without refund.

9. Refunds

Outside the statutory right of withdrawal (14 days), no refund is granted for a subscription period already started.

In the event of prolonged unavailability of the Service attributable to PokéItem (more than 72 consecutive hours), proportionate compensation may be granted in the form of a subscription extension, at PokéItem's discretion.

10. Changes to the Service and pricing

PokéItem reserves the right to modify the content of the Pro features or the pricing at any time. In the event of a material change unfavourable to the user, the user will be informed by email with at least 30 days' notice and may cancel their subscription free of charge before the changes take effect.

11. Personal data and billing

The data collected upon subscription (email address, payment data via a provider) is used solely for managing the subscription and billing. It is processed in accordance with PokéItem's Privacy Policy.

Billing data is retained for the legally required period (10 years for accounting documents).

12. Governing law and jurisdiction

These ToS are governed by French law. Any dispute relating to their interpretation or performance, failing an amicable resolution, falls under the jurisdiction of the courts of Toulouse.
